The “Terms of Service” sets forth the conditions of the “Member”s use of “Madam house of Webcam” and “eLm” (hereinafter “The Sites”), provided by “SR Online” (hereinafter “Head Office”). Please read carefully as you must fully agree to the “Terms of Service” to use our websites.
Article 1. Definition of the “Member”
Paragraph A.
“Member” shall mean those persons who have applied and registered for the use of “The Sites” according to the procedures specified by the “Head Office”, upon acknowledgement of the “Terms of Service”. The “Member” is considered as agreed to this terms when he has finished registration of membership of “The Sites”.
Paragraph B.
Following applicants shall not to be approved to be a “Member” by the “Head Office”.
- in case that the applicant is under 18.
- in case that the applicant has made false statement on the registration.
- in case that the applicant has made violation to the terms and the “Head Office” has already given deregistration.
- in case that the applicant is a minor, a ward or a person under curatorship and has not obtained the consent of the guardian or the curator (including cases in which the “Member” is subject to ruling for commencement of the above); or
- in case in which the “Head Office” determines the “Member” inappropriate.
Paragraph C.
In the event that the “Member” falls under any of the following events, the “Head Office” may without notification immediately suspend the “Member” use of all or a part of “The Sites”, or may deprive the membership of the correspondent “Member”.
- when the same individual registers for membership more than once.
- when “Member” does not fully perform his obligations stated on the “Terms of Use”.
- in case that the “Member” falls under above Article B.
- in case that the “Member” falls under above Article 7, or
- Other events in which the “Head Office” determines the “Member” inappropriate.
Article 2. Responsibility of managing “Member” information
Paragraph A.
The “Member” shall be responsible for managing his ID and password. The “Member” shall be liable for damages caused as a result of insufficient management of his ID and password, errors in use and use by third parties. The “Head Office” or performers of “The Sites” shall bear no liability.
Paragraph B.
The “Member” shall not sell, transfer, or lend his ID and password to any unrelated third party.
Paragraph C.
The personal information provided by the “Member” for “The Sites” is assumed as information of himself. In case the “Member” use of false information has been uncovered, the “Head Office” may deprive the membership of the correspondent “Member” under the paragraph C of Article 1 of this term. The disputes occurred in the event shall be settled amicably between each other.
Paragraph D.
The “Member” shall be responsible for his actions on these sites in the similar manner as general community.
Article 3. “Member”s Personal Information
The “Member”s may receive advertisement at random times.
- The “Member”s do not receive emails which include advertisements other than “The Sites”.
- The personal information of the “Member” is kept securely by the site administration and will not be disclosed to any third party. We protect personal information provided by our users and take elaborate security measures against unauthorized access from outside parties, loss or damage, falsification and ruination of the personal information.
- The personal information of the “Member” is not shared with outside parties except when it is necessary for “The Sites’ operation.
Usage of IP address
“The Sites” collect and store IP Address (*1) for system management and use it for analyzing the site’s functionality. The stored IP address normally is not connected to the user’s personal information. However, the IP address may be used to identify the “Member” only for protection of the rights, operation of “The Sites” and other users’ safety.
Some service of “The Sites” may show the original poster’s IP address. Users shall review the terms before using the service of “The Sites” and then provide necessary information.
(*1) In case of using the internet, an identification number is allocated to each computer device.
Article 4. “Withdrawal from membership
In the event that a “Member” wishes to withdraw from membership, the “Member” shall send email to the “Head Office” for the approval of his withdrawal. After the membership is cancelled the “Member” shall lose his credit.
There is no charge for the withdrawal.
The “Member” shall not repeatedly become a “Member”.
Article 5. Service of “The Sites”
Paragraph A.
The “Head Office” shall provide the service of “The Sites” which is tenderable at the time. By posting the notice to “The Sites”, the “Head Office” shall be allowed to terminate or change the service content on these sites without obtaining consent from the “Member”.
Paragraph B.
In the event of periodical or urgent maintenance of the system of the Services, acts of providence, incidents, or other emergency situations or the possibility of such acts occurring, the “Head Office” may, at its discretion, discontinue or suspend all or a part of the operation of “The Sites” on temporary basis without prior notice to the “Member”.
Paragraph C.
The “Head Office” may, at its discretion, suspend the operation of “The Sites” with prior notice to the “Member”. This notice shall be announced on “The Sites” or by other means provided by the “Head Office”.
Paragraph D.
Regardless of reason, the Company shall bear no liability with respect to damages incurred by the “Member” or third parties due to the change, discontinuation or delay of all or a part of the operation of “The Sites”.
Paragraph E.
Although our「Consultation and counseling service」(such as life counseling, fortune telling etc.)is engaged in providing the best experienced counseling service available, we shall not guarantee the happenings of any future events.
Paragraph F.
In the event of using the counseling or after the use of the service, the user of the counseling shall act with his own responsibility.
The “Head Office” and information provider shall bear no liability for compensation or damages of any kind whatsoever including refunding counseling fee as a result of unwanted fortune telling or counseling.
Paragraph G.
The “Head Office” shall provide the service of “The Sites” which is tenderable at the time.
By showing on “The Sites”, the “Head Office” shall be allowed to terminate or change the service content on “The Sites” without obtaining consent from the “Member”.
In the event of periodical or urgent maintenance of the system of the Services, acts of providence, incidents, or other emergency situations or the possibility of such acts occurring, the “Head Office” may, at its discretion, discontinue or suspend all or a part of the operation of “The Sites” on temporary basis without prior notice to the “Member”.
The “Head Office” may, at its discretion, suspend the operation of “The Sites” with prior notice to the “Member” at least one month before the suspension. This notice shall be announced on “The Sites” or by other means provided by the “Head Office”.
Regardless of reason, the “Head Office” shall bear no liability with respect to damages incurred by the “Member” or third parties due to the change, discontinuation or delay of all or a part of the operation of “The Sites”.
The “Head Office” shall bear no liability for textures, contents, and regulations of the service made by the “Member”.
The performers shall be liable for all activities in the service and its contents.
The “Member” shall agree to use the service and exposure to risk at his own responsibility. He shall actually judge the reliability, accuracy, benefits and maturity of the content. The “Head Office” shall bear no liability for contents of the service provided by the performers.
Article 6. Credits
Paragraph A.
Payment methods and fees for using services are determined by the “Head Office” and shall be displayed on “The Sites”.
Paragraph B.
The “Member” shall be liable to pay any taxes, bank transfer fees and other charges incurred while paying for the service.
Paragraph C.
The “Member” shall purchase the “credit” to be able to use the services provided by the “Head Office”. Obtained “credit” shall not be exchanged for money.
Paragraph D.
The credit purchased is valid for the five and a half-month period from the last day of corresponding month.
The credit received as complimentary from “The Sites” shall be valid for the period of 1 month from the date of the last credit usage.
Article 7. Prohibitions
Paragraph A.
The “Member” shall not perform the following acts while using “The Sites”.
- Acts against public order and morality, or other potential acts considered by the “Head Office” unacceptable.
- Acts connected to criminal acts. Or other acts considered by the “Head Office” as potentially criminal.
- Acts of searching someone for prostitution.
- Acts hampering the operation of “The Sites”.
- Acts slandering the credibility of the services or “The Sites”.
- Acts of self advertisement, soliciting and/or commercial enterprising of religious organization.
- Acts infringing the copyright, image right or other rights of “The Sites” users and third parties, or acts considered by the Company as potentially infringing.
- Acts infringing on the asset or privacy of other “Members”, third parties or “The Sites” or acts considered by the “Head Office” as potentially infringing;
- Acts causing disadvantage or damage to other “Members”, third parties or “The Sites” or acts considered by the “Head Office” as potentially disadvantageous or damaging;
- Acts defaming other “Members”, third parties or “The Sites”, or acts slandering the reputation and credibility of other “Members”, third parties or the “Head Office”, or other potential acts considered by the “Head Office”:
- Acts hampering the smooth operation of “The Sites”.
Use of non-”Member”
- Acts of inducement of other sites or other business.
- Acts infringing on the rights of the third parties.
- Acts disclosing personal information or indentifying individuals.
- Direct contacts of any kind, tipping, giving gratuity to the performer outside “The Sites” or any attempts to do it.
Paragraph B.
In case the “Member” causes disadvantage or damage to the third parties, the “Member” shall settle such dispute at his own responsibility and expense. He shall cause no inconvenience or damage to “The Sites” in this respect.
In the event that the “Member” causes damage upon the “Head Office” and the performers on “The Sites” in connection with the violation of “The Terms of Service”, the “Head Office” and the performers on “The Sites” may claim compensation for damage. The “Head Office” may suspend or terminate the “Member” ID without prior notice.
Paragraph C.
In the event that the “Member” forces the performer on “The Sites” to do unpleasant conduct, threatens or acts inappropriately, the “Head Office” may suspend or terminate his membership without prior notice.
Article 8. Deletion of inappropriate registration information
In case the “Head Office” determines that registered text on “The Sites” falls or may fall under the Article 6 of this term, the “Head Office” may eliminate the text or information without prior notice to the “Members”.
Article 9. Right of Publicity, Copyright and other rights
Paragraph A.
All performers on “The Sites” are protected under copyright law and have right of publicity. They can profit from the commercial use of their photographs, however, materials shall not be used illegally by the third party.
In the case of unauthorized publicize or diversion of the photographs, images and motion pictures of the performers, the “Head Office” shall call for immediate cessation of membership and may institute a claim for the damages.
Paragraph B.
Copyrights and all other rights with respect to information such as documents, designs, trademarks, images, movies, audio resources and voices provided on “The Sites” belong to the “Head Office” and all rights reserved. In the event of violation of the terms set forth in this Article and causing a trouble to certain extent, the “Head Office” giving warnings to violators shall call for cessation. In some cases, the “Head Office” shall institute a claim for the damages.
Paragraph C.
If there are other cases of violation of the law not stated above, “The Sites” shall contact the law-breaker and take legal action whenever necessary.
Article 10. Changes in Terms of Service and validity
The terms, rules and adjustments which the “Head Office” announce through “The Sites” on any occasion, shall be integral part of this “Terms of Service”. The “Head Office” may make changes in the “Terms of Service” and other terms where necessary, without “Member”s’ consent and prior notice. The modified terms shall take effect as soon as announced on “The Sites”.
Article 11. Court of Jurisdiction
The Terms of Service shall be governed and construed under the laws of Japan. Any disputes between the “Member” and the “Head Office” in connection with “The Sites” shall be resolved between the “Member” and the “Head Office” upon negotiation in good faith. In the event that the above dispute cannot be resolved upon negotiation, lawsuits filed shall be subject to the exclusive jurisdiction of the Tokyo District Court as the agreed court of the first instance.
Article 12. Matters outside of the Term
Any disputes between the “Member” and the “Head Office” not mentioned in these terms shall be amicably resolved between the “Member” and the “Head Office”.
